While we’re requiring ADVERTISERS to advertise their properties truthfully and accurately, we have no control over the accuracy of any advertisement of the capacity of any ADVERTISER to make a booking with a RENTER. HolidayStaying.com is monitoring the listed properties very carefully to detect and remove any advertisements that are not in compliant with our Terms & Conditions and ADVERTISER or listed properties that have received complaints from RENTERS.

In recognition of this, you agree to waive any claim you may have against us that is in any way connected with a dispute you have with a user of our site; and compensate us for any losses or liability suffered as a result of any claim against us by a user of our site or any other third party in relation to your dealings with users of our site and third parties.
Laws and jurisdiction
HolidayStaying.com (and holding company Media Vertigo d.o.o.) operates under laws of Republic of Croatia. In case of any disputes the courts of Dubrovnik and Croatia will have exclusive jurisdiction over all maters related to our WEBSITE. Accuracy of information provided to HolidayStaying.com
Data and information submitted during the member’s registration process and during all further communication with HolidayStaying.com shall be true, correct and verifiable. Each registered member agrees to provide updated information regarding any changed information previously sent to HolidayStaying.com.
Advertising eligibility
Upon our request, each registered member agrees to promptly provide proof of personal identification, proof of ownership of the property advertised and proof of authority to list the property.
Prior to activation of a submitted property listing, all provided content and information is subject to our approval. HolidayStaying.com reserves the right to review and amend content and information the advertiser (OWNER) provided with no prior notice.
One unit
Each property listing may represents only one holiday unit, unless prior permission has been given by us. HolidayStaying.com may edit or change property listings not adhering to this policy.
Substitution of property listings
Each property listing on HolidayStaying.com represents a specific property, and we do not allow members to substitute it for another listing via changing location information, text or photos unless prior permission has been given to the advertiser by HolidayStaying.com. HolidayStaying.com reserves the right to suspend or remove any property listing not respecting this advertising rule. In case of removal of the property listing no money refund will be issued to the advertiser in question.
No return policy
-HolidayStayings.com has a no return policy for any paper based information sent to us for the purpose of creating a property listing, including photographs.
Handling of submitted photographs
-HolidayStaying.com will use all reasonable efforts to reproduce faithfully any photographs submitted, but will not be held responsible for any loss or damage or harm otherwise resulting from any defect in this regard.
Copyright of submitted advertising material
For any photo and text submitted to HolidayStaying.com (both offline and online) for the purpose of creating a property listing, OWNER represents and confirms that it holds all intellectual property rights with respect to each submitted photograph (or text) or it has secured from the copyright holder all rights necessary for the photograph (or text) to be used in online advertising on HolidayStaying.com
In respect of any information you provide to us or other users of our site you will retain all rights you have in the Intellectual Property in such material, but you agree to:
* warrant to us that the material is your own original work and not entirely or partially copied from any other material; that you have all consents necessary to upload the material; that the material is accurate, complete and true; and that the material does not defame, cause injury to or invade the privacy of or otherwise infringe or violate any statutory, common law, regulatory or Intellectual Property rights of any third party;
* compensate us for any losses or liability suffered as a result of any claim against us by another user or any other third party in relation to the material which you provide;

VAT
HolidayStaying.com operates under Republic of Croatia financial laws that require from us to collect VAT (Value Added Tax) of 22% on all advertising fees from residents of Croatia or companies registered in Croatia.
VAT will not be charged to residents of any other countries and companies registered in any other country.
Unless specified differently, all published advertising prices for advertisers who are residents of Croatia or companies registered in Croatia already include the VAT of 22%. If you’re a company registered in Croatia with no obligations to VAT, please contact us for prices excluding VAT.
Rental payment
-No member may request any holiday maker or renter to make payments using any money transfer services like Western Union or MoneyGram (and others) for all or part of the property rental money transaction. Any violation of this term may result in removal or suspension of the property listing in question from our website without prior notice and without refund.
Advertising duration
-All advertising services are sold to run the full term that is chosen by the member. Refunds are not issued if the property is removed or deactivated from our database by the member’s choice. Refunds will also not be issued for any removal of the property listing caused by the member’s breaking of any part of Terms & Conditions posted here.
HolidayStaying.com may remove a property listing
-If the advertiser (member) posted or attempted to post any unsuitable material into our database, abused the property management system, abused the payment system. No refunds will be issued.
-If HolidayStaying.com received substantiated complains from any number of site users about a specific listings misrepresenting the property, its surroundings, or the inappropriate behavior of an Advertiser (member) – we reserve the right to remove the listing without prior notice, and issue no refunds.
-We reserve the right to refuse of remove any property listings from the website, that we consider to be unsuitable, incomplete or misleading. No refunds will be issued.
Termination of advertisement
-If a member wishes to have its listings removed from HolidayStaying.com website before the end of the paid advertising period, this will be done as soon as we receive formal request from the member via email or paper post. In this case the member needs to provide the username and property listings ID. No refunds will be issued.
Property listing transfers
-No property listings can be transferred or sold to another party,(1) except that if a member sells the property that is listed, the member may transfer its listings to the new owner of the property that is listed. With prior notice to HolidayStaying.com the transfer process if free of any additional charge. If we suspect a property listings has been transferred or sold to another party, and no reasonable reason (1) has been provided to us, we may remove or suspend the property listings with no prior notice and no issued refund.
Return & Refund policy
-HolidayStaying.com offers a 24 hour refund period for any advertising services purchased from HolidayStaying.com – starting from the time the purchase has been made. In such case HolidayStaying.com agrees to refund the full amount of the paid advertising service(s). However due to the nature of modern financial transactions, HolidayStaying.com may keep a percentage of money paid to cover expenses created by the refund process. Please note that this refund policy can be used by a member only for the first property listing and for the first time purchase of any advertising. If you wish to request a refund, please contact us via support@holidaystaying.com or by using the “contact us” form on the HolidayStaying.com website.
Contact availability
-Members (OWNERS) agree to be available for respond to rental enquiries by telephone or email (or both). HolidayStaying.com reserves the right to suspend any property listing if the member is reported to be unresponsive or unavailable for contact for 10 days or more. If your property listing has been temporarily suspended, please contact us via email or phone and request re-activation of your listings
Member review response
-Each member has the right to provide response to any review posted on HolidayStaying.com. The member’s response will be published under the original review with easily distinguishable font color and section title. HolidayStaying.com may request further information from the review sender and the member. HolidayStayings.com reserves the right not to publish the member’s response if we consider it to be unsuitable, misleading, untruthful or unsubstantiated.
Advertising prices
-We reserve the right to change the advertising prices without prior notice. Any new rates will be applicable immediately for all new advertisements and renewals for both new and existing advertisers.
Safety
Consideration should always be given to the nature of advertisements and contracts transacted on the Internet, and the risks involved. Although we encourage members and renters to make direct contact with each other, you may never meet or directly speak to an member or a renter, and you must therefore proceed with care and judgment when using the HolidayStaying.com website.

Advertising prices
-We reserve the right to change the advertising prices without prior notice. Any new rates will be applicable immediately for all new advertisements and renewals for both new and existing advertisers.
Safety
Consideration should always be given to the nature of advertisements and contracts transacted on the Internet, and the risks involved. Although we encourage members and renters to make direct contact with each other, you may never meet or directly speak to an member or a renter, and you must therefore proceed with care and judgment when using the HolidayStaying.com website.
Your waiver and indemnity (for advertisers/members)
Your contract for the rental of your listed property on our site is directly with the user (holiday maker) of our site, and you agree that HolidayStaying.com will not be a party to that contract at any moment. In recognition of this, you agree to waive any claim you may have against us that is in any way connected with a dispute you have with a user of our site; and compensate us for any losses or liability suffered as a result of any claim against us by a user of our site or any other third party in relation to your dealings with users of our site and third parties.
Our liability and responsibility
Holidaystaying.com is an advertising website, providing advertising services to property owners and we make no representations or warranties regarding the capacity of any user of our site to make a booking with HolidayStaying.com members.
To the extent permitted by law, we and third parties connected to us hereby expressly exclude:
-All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
-Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation, any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
